1. Scope

These Terms and Conditions apply to all orders placed through destroyerbrand.it by consumers and business customers. Deviating terms of the customer do not apply unless we have expressly agreed to them in writing.

2. Contract Conclusion

Our product listings constitute an invitation to submit an offer. By clicking "Buy now" / "Complete order" you place a binding order. The contract is concluded when we send you an order confirmation by email.

We reserve the right to refuse an order (e.g. in case of payment failure or stock unavailability), in which case we will notify you promptly.

3. Prices and Payment

All prices are shown in EUR including VAT. Shipping costs are displayed separately during checkout.

We accept: credit card (Visa, Mastercard, Amex), PayPal, and other payment methods displayed at checkout. Payment is due immediately upon order.

4. Delivery and Shipping

  • Delivery within Italy: 3–5 business days
  • Delivery to EU countries: 5–10 business days
  • Free shipping on orders over €79

Risk of loss passes to the customer upon handover to the carrier (for business customers) or upon delivery (for consumers).

5. Right of Withdrawal (Consumers)

Consumers have a 30-day right of withdrawal from the date of receipt of the goods — exceeding the legally required 14 days.

To exercise your right of withdrawal, contact us at info@destroyerbrand.it with your order number before the 30-day period expires. Return shipping costs are borne by the customer unless the item is defective.

The right of withdrawal does not apply to personalised or custom-made products.

6. Returns and Refunds

Items must be returned in their original condition (unworn, with tags attached). Upon receipt and inspection of the returned item, we will process your refund within 14 days to the original payment method.

7. Warranty

We provide a 2-year statutory warranty in accordance with Italian consumer law (D.Lgs. 206/2005). If a defect appears within the first 12 months, it is presumed to have existed at delivery. Please contact us at info@destroyerbrand.it with photos and your order number.

8. Liability

We are fully liable for intent and gross negligence. For slight negligence, we are only liable for breach of material contractual obligations (cardinal obligations). Liability for indirect damages and lost profit is excluded to the extent permitted by law.

9. Applicable Law and Jurisdiction

These Terms are governed by Italian law. For consumer disputes, the consumer may bring proceedings in their country of residence or in Italy. For business-to-business disputes, the Court of Bolzano (BZ) has exclusive jurisdiction.

The EU Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr. We are not obligated and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
